The 30-Day Rule
Under DOLE Labor Advisory No. 06-20, employers should release an employee's final pay within 30 calendar days from the date of separation โ whether the employee resigned, was terminated, retired, or reached the end of a fixed-term contract. A different timeline can apply only if a company policy or an individual/collective bargaining agreement expressly provides for one.
What's Included in Final Pay
- Unpaid basic salary up to the employee's last actual day of work
- Pro-rated 13th month pay for the portion of the year worked
- Cash conversion of unused Service Incentive Leave (SIL) or vacation leave credits, per company policy
- Separation pay, if the separation ground legally requires it (e.g., redundancy, retrenchment)
- Tax refund from the year-end annualization of withholding tax, if any was over-withheld
- Retirement pay under RA 7641, if applicable
- Any other benefits due under company policy, individual contract, or a CBA
Final Pay vs. Back Pay: Same Thing?
In everyday usage, Filipinos often use "back pay" and "final pay" interchangeably to mean the same lump sum released after separation. Technically, back pay can also refer more narrowly to wage differentials owed due to underpayment or a labor arbitration award โ money owed for hours or benefits that should have been paid earlier but weren't. Both are still subject to the same 30-day DOLE release guidance.
